If you become a counselling, psychotherapy or supervision client, I may also need to collect additional information relevant to providing the service, including contact and emergency-contact details, session and appointment information, payment records, counselling or supervision records and other information you choose to share with me.
During counselling or psychotherapy, this may include sensitive information relating to your physical or mental health and other aspects of your personal circumstances.
Some of this information is classed as special category data under UK GDPR and receives additional legal protection.
Why I use your information
I may use your personal information to:
-
Respond to enquiries;
-
Arrange free consultations;
-
Provide counselling, psychotherapy and clinical supervision;
-
Manage appointments and communicate with you;
-
Maintain appropriate professional records;
-
Process and record payments;
-
Meet professional, safeguarding, insurance and legal obligations;
-
Maintain the security and effective operation of my website and practice.
I will only collect and use information that is relevant and necessary for these purposes.
Lawful basis for processing your information
Data-protection law requires me to have an appropriate lawful basis for processing personal information.
Depending upon the circumstances, this may include processing that is necessary to take steps at your request before entering into a contract, to perform my contractual relationship with you, to comply with a legal obligation, or where I have a legitimate interest in operating and administering my professional practice.
Where I process special category data, such as information concerning your health, an additional condition under Article 9 UK GDPR must also apply.
The appropriate basis and condition depend upon the particular purpose for which information is being processed. The ICO requires organisations processing special-category information to identify both an Article 6 lawful basis and an appropriate Article 9 condition.
Confidentiality and sharing your information
Information you share with me is treated confidentially.
I do not sell your personal information.
There may, however, be limited circumstances where information needs to be shared, for example:
-
Where I am legally required to disclose information;
-
Where there are safeguarding concerns;
-
Where there is a serious risk of harm;
-
With professional or regulatory bodies where required;
-
With carefully selected service providers that help me operate my practice, where appropriate safeguards are in place.
The limits of confidentiality relating specifically to counselling or supervision are explained further within the relevant counselling or supervision agreement.
Clinical supervision
As part of ethical counselling practice, aspects of therapeutic work may be discussed within clinical supervision.
The purpose of supervision is to support safe, ethical and effective practice. Wherever possible, information is discussed without identifying the client.
My clinical supervisor is also bound by professional confidentiality requirements.
Children and young people
I provide counselling services to children and young people and therefore may process personal information relating to individuals under the age of 18.
Where appropriate, information may also be collected from a parent, guardian or other person involved in arranging counselling.
I take particular care when handling children's personal information and will only collect information that is necessary for providing the service and meeting my professional, safeguarding and legal responsibilities.
How your information is stored
I take reasonable steps to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.
Information may be held securely in electronic and/or paper form. Appropriate safeguards are used according to the nature and sensitivity of the information.
Where third-party systems are used to provide services such as website hosting, forms, email or video communications, those providers may process information in accordance with their own privacy and security arrangements.
How long I keep your information
I do not keep personal information for longer than is reasonably necessary.
Different types of information may need to be retained for different periods depending upon professional, legal, safeguarding, insurance and regulatory requirements.
When information is no longer required, it will be securely deleted or destroyed.
I would customise this paragraph before publishing. If your insurer/BACP/NCPS procedures specify a particular retention period for client records, put the actual period here. The ICO expects your privacy notice to state how long information is retained, or explain how you determine that period.
